PLANNING REQUIREMENTS
The Client will be
responsible for payment of all fees.
It should be noted that we cannot guarantee that a planning application will
receive consent. We will endeavour to ensure that all submissions will be
compliant with both National and Local Planning Authority policies and guidelines,
but many aspects of the process are subjective and open to interpretation.
Please also note that applications for the discharge of conditions are subject
to a fee payable to the Local Planning Authority. The fee is payable on a ‘per
submission’ basis and may refer to one or more conditions. If possible, we would
seek to make just one application for the discharge of any conditions that are
attached to the consent.
Community Infrastructure Levy
All London Boroughs are implementing a local area tax regime to raise money
for investment in the public realm and community facilities and services. This is
a direct tax on development as it is held that new buildings or extensions greater
than 100 sq. m will create additional demand on existing infrastructure.
BUILDING REGULATION REQUIREMENTS
Compliance with the Building Regulations is a legal requirement and is the
responsibility of the person commissioning the work. Some types of building
work – notably insulation, new windows and doors and electrical modifications
– can be undertaken by Contractors/Installers provided that they are registered
as ‘selfcertified’ under an appropriate accreditation scheme. Most other work
however must be checked (at design stage and/or on site) by making a formal
application for Building Regulation Approval to a Local Authority or an Approved
Inspector (AI).
The preferred course of action is to submit proposals for approval in advance of
any work being carried out. This is known as a Full Plans submission.
If an AI is to be appointed, they are required to serve an Initial Notice on the Local
Authority which is a legal requirement to let the Authority know that construction is
due to commence and that the AI will be the checking authority.
Whilst the Design Team Consultants will prepare and submit all necessary design
information to the Local Authority (or AI) the Client will be responsible for payment
of all fees.
