The main principles set out in the initial fee proposal for the Architect/Consultant are
still valid for the appointment of the Principal Designer although the role and scope
of services are different.

The CDM Regulations were introduced by the UK Health and Safety Executive
some years ago to reduce the incidence of death and injury in the construction
industry. The current CDM Regulations came into force in 2015 and now apply
to all projects to ensure that the design and detailing of a project and the way it
is executed will as far as possible eliminate risks to contractors and end-users.
Please see the attached Information for Clients which outlines your obligations
under the Act. The RIBA recommends that the default choice for the role of
Principal Designer should be the Architect. We would be happy to undertake this
role in addition to our other services, but for legal reasons we would need to be
appointed under a separate and distinct contract.
On this basis we would be pleased to provide the Principal Designer services and
set out below our understanding of the prospective appointment, the scope of
services to be provided and a fee proposal.

SCOPE OF SERVICES
Our duties will be those allocated to the Principal Designer by the CDM
Regulations 2015 and the HSE Guidance on the Regulations L153 ‘Managing
health and safety in construction’ published 2015. The precise scope of each
service must be read within the context and the limitations of the Regulations
and the HSE Guidance on the Regulations L153 as a whole and its interpretation
should be limited to the overall objective of complying with the same.
We will undertake the duties as ‘Principal Designer’ for the project as set out in the
Construction (Design and Management) Regulations 2015 (CDM Regulations)
