Letter making a speculative or conditional offer
The Architect/Consultant may be asked to provide services to (say) a Design and
Build contractor, who was submitting a tender to the developer, on a speculative
basis. The Architect/Consultant, having considered the risks involved, may decide to
do so. However, if working ‘at risk’ is not an option, the Architect/Consultant should
detail in the letter the terms on which the offer is made. The law does not generally
support claims for payment for doing work in the expectation of obtaining a contract.
The bidding process is speculative, and the associated costs are not normally
recoverable.
