As this project is for work to your
home, this form of contract is a
‘consumer’ contract as defined under the Consumer Rights Act 2015 and we
confirm that we drew your attention to, and explained the purpose of each of the
key clauses and in particular:

payment and Payment Notices (clauses 5.10 to 5.24)
the limitation of liability (clauses 7.1, 7.2 and 7.3)
professional indemnity insurance (clause 8)
dispute resolution (clause 9).
You should be aware, however, that if your home is to be let at any time as a
holiday let or to other tenants on a commercial basis, then the contract would be
a ‘business’ contract where the Consumer Rights Act no longer applies. Please
let us know if this might be the case and we will amend the form of contract
accordingly.
If these arrangements are acceptable to you, and to confirm your agreement to
these terms and conditions, please sign and date a copy of this letter and return
it to this office as an instruction to proceed. Once we receive this we will be in
a position to start work and prepare the formal contract documents. However,
because the RIBA Domestic Professional Services Contract 2018 is a consumer
contract you have the statutory right to cancel the contract within 14 days of
signing this letter by giving us formal notice in writing.
