Completing an Agreement

Party Wall Surveyor
On reviewing the initial scope of work, it is
that the Party Wall
etc. Act 1996 will apply and there may be a need for a Party Wall Surveyor to be
appointed if your neighbour objects to the work. We can advise further at the
appropriate time.
THE SERVICES
In providing the services we will exercise the level of reasonable skill, care and
diligence expected of an Architect/Consultant in accordance with the normal
standards of the profession.
We will keep you informed of progress and advise on any decision or action
required or any issue that may materially affect the delivery, cost or quality of the
project.
Copyright
We own the copyright in the drawings and documents that we produce for your
project and we generally assert our moral rights to be identified as the author of
that work. However, subject to the payment of fees and/or other amounts properly
due, you may copy and use those drawings and documents for purposes related
to this project only. Your right to copy and use does not extend to any future
purchaser, leaseholder or tenant of your property without further consent from us.
Liability
Our liability to you will expire
years from the completion of the
services or practical completion of the building works, if earlier.
We carry professional indemnity insurance as required by the Architects
Registration Board and the Royal Institute of British Architects. We agreed that the
amount of professional liability insurance cover to be maintained for this project
will be limited to £
in respect of each and every claim or series
of claims arising out of the same originating cause.
Until the expiry of the liability period, professional indemnity insurance cover will
be maintained for that amount to be available for your project except for claims
arising out of:
• pollution or contamination, where the annual aggregate limit is

Documentary evidence of the insurance can be provided, if required.
Disputes
We aim to provide a professional standard of service, but if at any time you are not
satisfied, please bring the issue to my attention as soon as possible and we can
discuss how to resolve the issue. However, in the event of such an eventuality,
we hope that we shall be able to settle the matter without recourse to the dispute
resolution procedures to be set out in the Contract Details. We have agreed that
the initial and preferred dispute resolution process will be

complaints procedure which is available on request.
The Agreement
The formal contract terms will be based on this letter and the RIBA Domestic
Professional Services Contract 2018, a copy of which is enclosed for reference.
Note that this is a specimen copy of an agreement and is not intended for use
on this project but to provide an overview of the contract to be used. Upon
confirmation of our appointment we will prepare the project-specific contract.
