Assembling a Collaborative Project Team
Building Contract is aligned with the completed professional services contracts.
For example, ensuring that the consultant appointments (professional services
contracts) are aligned to any contractor design responsibility included in the
Building Contract. The suite comprises:
•RIBA Concise Conditions of Appointment for an Architect – this suite of
documents is intended for use on small non-domestic projects
•RIBA Conditions of Appointment for an Architect for a Domestic Project –
as the title suggests, this suite is intended for use on residential projects
•RIBA Standard Conditions of Appointment for an Architect – for use on all
other projects of any size. This appointment document can be used by the
client in conjunction with the Standard Conditions of Appointment for a
Consultant, allowing the client to appoint other consultants under the same
terms as the architect.

The NEC Professional Services Contract (PSC) is intended for use in the
appointment of any member of the project or design team providing professional
services and is now the form of contract used on the majority of public sector
projects. As well as including clauses on matters typically covered in other
standard forms (such as indemnity, insurance and liability, termination, dispute
resolution and payment) the NEC PSC includes clauses on other important
subjects, such as early warnings, the programme, the risk register, communications
and compensation events. The contract relies on mutual trust and cooperation
and the inclusion of these subjects aims to make the contract more collaborative.
The PSC is aligned with the NEC3 Building Contract to ensure that the contractor
is appointed in the same collaborative manner as the rest of the project team.

The CIC Consultants’ Contract package consists of the CIC Conditions (2nd
edition) and the CIC Scope of Services. The Conditions have been developed for
use by experienced clients and consultants working on major building projects
and can be used by either development clients or contractor clients for the
appointment of any member of the design team. A number of supporting documents
work in conjunction with the package, including a warranty and novation agreement.
The CIC Scope of Services aims to provide clarity regarding the tasks to be
undertaken by each project role and also contains a template
for allocating design responsibility. It has been developed for use with the CIC
Conditions and other forms of contract but has not been widely adopted.

While the JCT’s primary focus is the development of their comprehensive suite
of Building Contracts, they also produce a consultancy agreement specifically
designed for use by public sector clients. This professional services agreement
can be used for the appointment of any member of the design team and is
suitable for use with the majority of JCT Building Contracts.
